Last Will and Testament of Jacob VanVolkingburgh, 1872, Woodhouse Twp., Norfolk Co.

Entered and registered this Twenty-seventh day of September, AD 1873 at ten o'clock and thirty-seven minutes P.M.

In the Name of God, Amen - This Instrument witnesseth that I Jacob VanVolkingburg of the Township of Woodhouse in the Cuonty of Norfolk and Province of Ontario, yeoman, being of sound and disposing mind, memory and understanding, do make, publish and declare this to be my last will and testament hereby revoking and making null and void all former last wills and testaments and writings in the nature of last wills and testaments by me heretofore made - 

My will is first that my funeral charges and just debts shall be paid out of my estate by my son in law George W. Smith of the Township of Woodhouse in the said County of Norfolk.  I bequeath to the said George W. Smith all and singular that ertain parcel of tract of land and premises situate lying and being in the Township of Woodhouse in the County of Norfolk and Province of Ontario containing by admeasurement seventeen acres be the same more or less being the North Half of the East Half of the West Half of Lot number Eighteen in the fifth concession of the aforesaid Township of Woodhouse, saving and except thereout Eight acres are described as follows that is to say Commencing at the distance of one quarter of the width of the said Lot from the North West angle thereof measured along Concession Road in rear of said Lot, thence along said Road on the same course Easterly three chains be more or less - thence fifteen degrees and forty minutes East be the distances as to embrace the desired Eight acres.  I hereby except out of the Seventeen acres heretofore devised, to said George W. Smith - two acres being composed of the South East corner - I also bequeath to my said son in law George W. Smith - all my farming utensils also one yoke of oxen two cows and one hog and any other personal property goods and chattels that I may own at the time of my decease.

I bequeath to my daughter Rachel two acres of land being composed of the South East corner of the said seventeen acres of land, and heretofore excepted out of the land devised to the said George W. Smith.  

- I further will and direct that my said son in law George W. Smith, five years after the date of my death, do pay or cause to be paid to my son 

William VanVolkingburgh, the sum of sixty dollars, and that the same be a lein on that parcel of land heretofore devised to the said George W. Smith.  

I further will and direct that the said George W. Smith, five years after the date of my death do pay or cause to be paid to my son
Joseph John Vanvolkingburgh the sum of fifty dollars and that the same be a lien on that parcel of land heretofore devised to the said George W. Smith.

I further will and direct that each of my daughters 

Eliza Jane Marr (wife of George Marr), 
Rachel VanVolkingburgh, 
Matilda Smith (wife of said George Smith), 
Elizabeth Vanvolkingburg, 
Mary Buchanan (wife of Anthony[?] Buchanan), and 
Catherine VanVolkingburgh

be paid the sum of Five dollars five years after the date of my death by the said George W. Smith and that the same be a lien on that parcel of land heretofore devised to the said George W. Smith.

I hereby further nominate and appoint the said George W. Smith as my sole Executor of this my last will and Testament.

In witness whereof I the said Jacob Van Volkingburgh herewith subscribe my name and affix my seal this the Twenty-Seventh day of April A.D. One thousand eight hundred and seventy-two.

Signed sealed published and declared by the said Testator Jacob VanVolkingburgh decreed[?] for his last will and Testament - in the presence of us who at his request and in his presence and in presence of each other have hereunto subscribed our names as witnesses hereto the same having first been read over and explained to the Testator who seemed perfectly to understand the same and made his mark thereto in our presence.

County of Norfolk
to wit.

I Albert Hamilton Backhouse of the Village of Port Rowan in the County of Norfolk, student at law, make out and say:

1. That the paper writing herefuno annexed is a true copy of the last will and testament of Jacob Van Volkingburgh late of the Township of Woodhouse in the County of Norfolk, yeoman.

[thereafter the name of the testator changes from Jacob to Joseph, probably in error.  However each instance of Joseph is underlined.  Perhaps a clerk underlined the error after the fact]

2. That I was personally present and did see the last will and testament of the said Joseph Van Volkingburh decased duly signed sealed and executed by the said Joseph Van Volkingburg at the Township of Woodhouse in the County of Norfolk.

3. That I knew the said Joseph Van Volkingburgh.

4. That I and one Samuel Ebersole are subscribing witnesses to the said last will and testament swore before us at Port Rowan in the County of Norfolk this 24th day of September A.D. 1873,
